Terms & Condition

1. Acceptance of Terms

By accessing or using ResolveKart's website, guidebooks, complaint-drafting tools, consultation calls, or filing services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Services. These Terms should be read together with our Privacy Policy.

2. Who Can Use ResolveKart

  • You must be at least 18 years old and legally competent to enter into a contract under the Indian Contract Act, 1872.
  • You confirm that all information you provide about your case is true, accurate, and not misleading to the best of your knowledge.
  • You are responsible for maintaining the confidentiality of your account login details.

3. Nature of Our Services

ResolveKart offers three broad levels of support, and it's important you understand what each one is and isn't:

  • DIY Guidance: Self-help guidebooks, templates, and checklists to help you file complaints (e.g. cybercrime portal, bank grievance, RTI) yourself.
  • Complaint Analysis: A review of your case and documents with a written opinion or recommended action plan, prepared by our in-house team or associated legal experts.
  • Full Filing Assistance: Drafting and, where applicable, filing complaints, escalation letters, or RTI applications on your behalf, based on instructions you provide.

ResolveKart is not a law firm, and use of our Services does not create an advocate-client relationship unless you are separately engaged with a listed, licensed advocate for representation before a court or tribunal. Where legal opinions are provided, they are prepared by qualified consultants but do not substitute for independent legal advice on complex or high-value matters.

4. No Guarantee of Outcome

Recovery of funds, registration of an FIR, freezing of a fraudulent account, or any other outcome depends on banks, police, RBI, courts, and other third parties outside our control. ResolveKart does not guarantee any specific outcome, timeline, recovery amount, or that any complaint will be accepted or acted upon by the relevant authority. Our role is limited to helping you prepare and submit your case as effectively as possible.

5. Your Responsibilities

  • Provide accurate, complete, and timely information and documents relevant to your case.
  • Promptly inform us of any material change in facts, deadlines, or communications you receive from banks or authorities.
  • Not use the Services for any fraudulent, false, or frivolous complaint.
  • Independently verify any instructions or drafts before they are submitted on your behalf, where we share them for review.

6. Fees, Payments & Refunds

  • Fees for each service tier are displayed at the time of purchase and must be paid in full before work begins, unless otherwise agreed in writing.
  • Payments are processed through our third-party payment partner; ResolveKart does not store your full card or UPI credentials.
  • Because our services involve professional time and effort (review, drafting, consultation) that begins promptly after payment, fees are generally non-refundable once work has commenced.
  • Refunds, if any, will be considered only where we are unable to deliver the paid service due to a failure on our part, and will be assessed case-by-case at ResolveKart's discretion.

7. Intellectual Property

All guidebook content, templates, website design, and text are owned by or licensed to ResolveKart and are protected under applicable Indian copyright and intellectual property law. You may use materials provided to you for your personal case only, and may not resell, redistribute, or publicly republish them without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law:

  • ResolveKart's total liability arising out of or related to the Services shall not exceed the amount you paid for the specific service in question.
  • We are not liable for indirect, incidental, or consequential losses, including loss of funds that a bank or third party fails to recover or refund.
  • We are not responsible for delays or failures caused by banks, police, courts, government portals, or other third parties beyond our reasonable control.

9. Indemnity

You agree to indemnify and hold ResolveKart, its employees, and associated consultants harmless from any claim, loss, or liability arising from false information you provide, misuse of the Services, or your violation of these Terms.

10. Confidentiality

We treat your case details as confidential in line with our Privacy Policy. Our legal experts and consultants working on your case are bound by confidentiality obligations. We may only share information with authorities such as police, RBI Ombudsman, or CERT-In on your instruction, or where legally required.

11. Suspension & Termination

We may suspend or terminate access to the Services if we reasonably believe your use violates these Terms, involves fraudulent or frivolous claims, or poses a risk to ResolveKart or its team. You may stop using the Services at any time; fees already paid will be handled as per Section 6.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be posted here with an updated "last updated" date, and where appropriate, registered users will be notified by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with the Services shall first be attempted to be resolved amicably, failing which it shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in [City, State], or, where arbitration is not applicable, to the exclusive jurisdiction of the courts at [City, State].
